Terms of service

The terms that apply when you use clinispecs.com.au or buy from CliniSpecs, including your Australian Consumer Law guarantees, which always come first.

Introduction

Welcome to CliniSpecs. These Terms of Service govern your use of clinispecs.com.au and any purchase you make from us (together, the "Services"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

Nothing in these Terms limits any right or guarantee you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. This applies despite anything else in these Terms (see "Australian Consumer Law" and "Consumer Guarantees" below).

Definitions

"CliniSpecs®", "we", "us" and "our" refer to the business operating clinispecs.com.au under ABN 46 651 552 206.

"you", "your" means the person using the Services or placing an order.

"Services" means clinispecs.com.au and any related purchase, account or support interaction.

"Products" means the clinical eyewear and accessories we sell through the Services.

Using our website

You may use the Services for personal or workplace use, lawfully and in good faith. You must not misuse the Services, including attempting to disrupt them, bypass our security, or access them in a way not permitted by these Terms.

Your account

If you create an account, you're responsible for keeping your login details secure and for all activity on your account. Tell us straight away if you think your account has been accessed without your permission.

You confirm that the information you give us (including your name, contact details and payment information) is accurate and kept up to date.

Orders

Placing an order is an offer to buy. We accept your order once we've confirmed and processed payment. We may decline or cancel an order at our discretion, for example, if a product is unavailable, priced incorrectly, or we suspect fraud, and we'll let you know using the contact details you provided.

Pricing

Prices are shown in AUD and include GST unless stated otherwise. Prices may change at any time, but the price charged is always the one shown at checkout when you place your order. Shipping costs, and any duties or taxes for international orders, are additional unless stated.

Payment

We accept the payment methods shown at checkout. You confirm you're authorised to use the payment method provided, and that all payment information you give us is accurate.

Shipping

We currently ship within Australia and New Zealand. Delivery timeframes shown at checkout are estimates, not guarantees. We're not liable for delays caused by couriers, customs, or anything outside our reasonable control. See our Shipping & Returns page for current details.

Risk

Risk in your order passes to you once it's handed to the courier. This doesn't affect your rights under "Consumer Guarantees" below if a product turns out to be faulty.

Returns

Returns and exchanges are handled under our Refund Policy, and always in line with your rights under the Australian Consumer Law.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right you have under the Australian Consumer Law, or any other law that can't lawfully be excluded. This clause applies despite anything else in these Terms, including "Limitation of Liability" below.

Consumer guarantees

Every CliniSpecs product comes with guarantees under the Australian Consumer Law that cannot be excluded, including that it will be of acceptable quality, fit for its intended purpose, and match its description. These guarantees apply in addition to, and are not limited by, any warranty we offer. Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited, at our choice, to repairing or replacing the product, or covering the cost of doing so.

Products

We design our clinical eyewear range for healthcare, dental and laboratory environments. Suitability for a specific task or workplace should be confirmed against a site-specific risk assessment and the relevant product documentation.

Our products are not designed for surgical, laser, radiological, ballistic, high-chemical-exposure, welding or similar high-hazard use.

CliniSpecs® products are designed and supplied as personal protective equipment (PPE) for healthcare, dental and laboratory environments. Unless expressly stated for a specific product, they are not classified as medical devices or therapeutic goods under Australian regulations. Product selection should always be based on the intended application, the relevant product documentation and an appropriate workplace risk assessment.

Availability

Products, colours and sizes may be limited or discontinued without notice. We'll let you know as soon as we can if something you've ordered isn't available.

Product accuracy

We describe our products as accurately as we can. Minor variations in colour or appearance may occur due to your screen or device. This doesn't affect your rights if a product doesn't match its description in a way that matters.

Colour disclaimer

Product colours shown on our website are as accurate as photography and screen display allow, but actual colour may vary slightly. If colour accuracy is important to your order, contact us before purchasing.

Intellectual property

Everything on the Services (including text, images, design and product documentation) belongs to us or our licensors, and is protected under the Copyright Act 1968 (Cth) and other applicable laws. You may use the Services for personal or workplace reference only. You may not copy, reproduce or redistribute our content without our written permission.

Trade marks

CliniSpecs®, EtherLens® and our other registered trademarks are protected by law. You may not use our trademarks, logos or other brand assets without our prior written permission.

Third-party links

The Services may link to websites or tools we don't control. We're not responsible for their content, accuracy or availability, and linking to them isn't an endorsement.

Acceptable use

Please use the Services lawfully. You must not attempt to harm, disrupt, or gain unauthorised access to the Services, impersonate another person, or interfere with our security measures. We may suspend or close your account if you breach this.

AI agents

If you use an automated or AI agent to access the Services on your behalf, it must clearly identify itself as an agent, must not disguise itself as a human user or bypass measures like CAPTCHAs, and must follow any access limits we set.

Security

We take reasonable steps to protect the Services and your information, but we can't guarantee they'll always be secure, uninterrupted or error-free.

Limitation of liability

Subject always to "Australian Consumer Law" and "Consumer Guarantees" above, and to the extent permitted by law, we're not liable for indirect or consequential loss arising from your use of the Services.

Indemnity

You agree to cover us for losses, damages or claims arising from your breach of these Terms, your misuse of the Services, or your breach of someone else's rights, except to the extent caused by our own breach of these Terms or of the Australian Consumer Law.

Force majeure

We're not liable for any delay or failure to perform caused by something reasonably beyond our control, including natural disasters, industrial action, courier or supply chain disruption, or government action. We'll let you know if this affects your order and work with you on a solution.

Privacy

Our Privacy Policy explains how we collect, use and protect your personal information, including information shared with Shopify and our other service providers to operate the Services.

Changes to these terms

We may update these Terms from time to time. The current version is always available on this page, with the date it was last updated. Continuing to use the Services after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Victoria, Australia, and you and CliniSpecs each submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Dispute resolution

If a dispute arises, contact us first. Most issues can be resolved directly and quickly. If we can't resolve it between us, either party may refer the dispute to the courts of the jurisdiction named above, or to any relevant industry or government dispute resolution scheme.

Severability

If any part of these Terms is found unenforceable, the rest continues to apply.

Entire agreement

These Terms, together with our Privacy Policy and other referenced policies, are the entire agreement between you and us regarding the Services, and replace any earlier versions.
